Terms and Conditions

We are always keen to offer our customers quality service. For this reason, we are dependent on our general conditions regarding the clarity of our contractual relationship. We kindly ask you to take a moment of your time to read the general conditions stipulated below. Thus, we are convinced that a service offering in line with the philosophy of our company can be guaranteed in the most optimal way.

1. General

By requesting a service, these general conditions are accepted by the customer and are valid for the total duration of the commercial relationship with OFDRS. The intermediary only submits to the commercial conditions of the principal if OFDRS has expressly accepted them.

2. Service request

  1. The customer makes service requests electronically or in another form. Any problems resulting from telephone or other requests are the responsibility of the client.
  2. The customer communicates the desired services to OFDRS, as well as his personal data and - where applicable - any special requirements.
  3. OFDRS is not responsible for delays or failures in implementation due to an insufficiently clear, incorrect or incomplete request, as well as for any defective transmission.

3. Price

All offers and prices are subject to demand. Prices are stated in EUR.

4. Response times

  1. No guarantee can be given for OFDRS response times. Response times will, of course, be established “in good conscience” and communicated to the customer, however, these are always forecast response times.
  2. A request is considered processed if the requested documents have been sent to the client

5. Disruptions, force majeure, closure or restriction of activity, network or server fault, viruses, etc.

  1. OFDRS is not liable for damage caused by disruptions to the activity of OFDRS, in particular by cases of force majeure, for example network or server defects, possible other transfer disruptions and other obstacles. cannot be influenced by OFDRS. If the cases cited above arise, OFDRS reserves the right to totally or partially withdraw from the commitments of the contract.

  2. The same thing applies if OFDRS must cease or partially or totally limit its activity for a specific period, in particular its online service that it makes available.

  3. OFDRS is not responsible for damage caused by viruses. In the event of data deliveries by e-mail, downloading to a page of this site or any other remote transfer, final control of the data lies with the customer. In this regard, the exclusion of claims for damages is acknowledged by the customer upon conclusion of the contract.

6. Liability

OFDRS is of course not responsible for errors in contracts caused by the principal and based on information or documents which are incorrect, incomplete or which were not made available on time or originating from illegible texts, or even from erroneous sources. The burden of proof regarding the correct and timely delivery of all information useful to OFDRS lies with the principal.

7. Payment terms

All fees and contributions are to be paid as contractually defined. In case of non-payment.

8. Personal data and preservation of confidentiality

All data is treated with extreme confidentiality. OFDRS undertakes to maintain the most absolute secrecy on all facts and data of which it becomes aware, in relation to its activity in favor of the client. The personal data requested from the customer is used to determine the details of the offer proposed to the customer. Absolute protection against the capture of company secrets and information, as well as other confidential data by unauthorized third parties, when transmitting texts and communications by computer between the customer and  OFDRS cannot be formally guaranteed by OFDRS, due to the technical possibility of intrusion by unauthorized persons into computer systems.

9. Language version

In the event of a dispute, only the French version of the general conditions is authentic.

10. Applicable law and Jurisdiction

The contractual relationship as well as the commercial relations between OFDRS and the client are exclusively governed by Luxembourg law. International commercial law is excluded. Any dispute, which involves the intermediary as plaintiff or defendant, will be under the exclusive jurisdiction of the Luxembourg courts.

11. Effectiveness

In the event that one or more provisions of this agreement are declared null and void, this will not result in the nullity of the entire partially valid provision nor that of the other provisions of this agreement. By submitting a request, the customer agrees to accept and respect the terms of the general conditions.
